When can I upgrade my package?
You may upgrade your trademark package at any time before an objection or Office Action is issued.
Once an objection has been issued, the original upgrade option is no longer available.
Why can’t I upgrade after an objection is issued?
The difference between package prices is not a retroactive upgrade fee.
Higher-level packages are priced before filing, when it is still uncertain whether an objection will be issued. They provide broader coverage by taking on that risk throughout the examination process.
Once an objection has been issued, the work is no longer a possible future risk. It is a confirmed assignment requiring review, research, drafting and filing. The applicable flat fee for responding to the objection will therefore apply.
This is similar to insurance: coverage must be purchased before the event giving rise to the claim occurs.
In some cases, Trademark Angel may offer a post-objection upgrade at a separately quoted fee. This is discretionary and depends on the nature and stage of the application.

You may also contact us by email or telephone, and we will provide an invoice for the applicable upgrade.
Do I have to upgrade?
No. Upgrading is optional.
We may recommend an upgrade where our search identifies potential obstacles or where broader package coverage is likely to offer better value and greater predictability.
When should I consider upgrading?
You should consider upgrading:
- after receiving our comprehensive search report, particularly where we identify a meaningful risk of objection;
- before filing an application covering multiple classes, where the higher package includes broader class coverage;
- where you want substantive Office Action responses included;
- where you want the benefit of an applicable refiling guarantee; or
- where greater predictability of the overall registration budget is important to you.
Any upgrade must be completed before an objection is issued.
If you do not upgrade and an objection is later issued, we can still assist with the response for a separately quoted flat fee.
Can I downgrade my package?
Downgrades are permitted only within 48 hours of purchasing the original trademark package.
This keeps all the useful points from the current page, but makes the core rule much harder to misunderstand. The current wording already states that upgrades are unavailable once an objection is received, but it repeats this in several places and does not clearly explain that the package difference is not a post-objection upgrade price.
